The UAE government has announced updated regulations concerning the validity of residence visas for expatriates who spend extended periods outside the country. These changes aim to clarify the conditions under which a residence visa can be maintained despite prolonged absences, as well as the process for re-entering the UAE if a visa has expired due to an extended stay abroad.

General Rule for Residence Visa Validity
Under the new regulations, the general rule remains that if an expatriate resident stays outside the UAE for more than 180 days continuously, their residence visa will be automatically nullified. Residents in this situation will need to apply for a new entry permit to re-enter the UAE.

Exceptions to the 180-Day Rule
However, several important exceptions have been outlined, allowing certain individuals to maintain the validity of their residence visas even if they stay outside the UAE for more than six months. These exceptions include:

Foreign Spouses: The foreign wife of an Emirati citizen.
Domestic Helpers: Accompanying Emiratis with scholarships abroad, UAE patients traveling for treatment, members of diplomatic missions, or those working in royal households abroad.
Expatriate Residents: Those sent abroad for medical treatment, public sector employees on training or working in offices abroad, and their families.
Students: Those studying in universities or institutes abroad, with specific regulations applicable depending on the emirate.
Investors: Holding valid residence visas.
Diplomatic Staff: Residents sponsored by UAE diplomatic and consular representatives and their dependents.
Special Cases: Any other individuals as decided by the Federal Authority for Identity, Citizenship, Customs, and Port Security (ICP), provided they meet the required conditions and pay the necessary fees.
Re-Entry Permit for Over 6 Months Absence
For residents whose visas expire due to staying outside the UAE for over six months, the government has outlined a procedure to apply for a re-entry permit:

Application Submission: Must be done from outside the UAE.
Timing: Applications can be submitted after staying outside the UAE for more than 180 days.
Justification: A valid reason for the extended stay must be provided.
Fines: A fee of AED 100 for every 30 days or part thereof spent outside the UAE must be paid.
